Professional Experience:

Attorney, Berkeley/Oakland, CA, 2001–present. My current practice focuses on legal, ethical, and business representation of psychotherapists, psychologists, and other licensed mental health professionals across the United States. I advise clinicians on professional corporation formation under the Moscone-Knox Act, multi-state telehealth and licensure compliance, HIPAA and CMIA privacy obligations, CANRA and Tarasoff duties, clinical documentation, subpoena and records release issues, board complaint exposure, and the corporate, employment, and contracting questions that arise in the operation of a clinical practice. I also represent licensed psychologists and psychotherapists in administrative proceedings before the Office of the Attorney General in response to formal accusations from their licensing boards. Through Lubofsky PC, I advise clinicians nationwide; through AttorneyTherapists.com and LawyerTherapists.com – both platforms that I founded – I have published more than 100 articles on legal and business issues for mental health professionals; and in 2026 I delivered the keynote presentation on EAP laws, ethics, and mental health at the U.S. Department of Energy’s Annual EAP Contractor Training. My dual licensure as both an attorney and a Licensed Marriage and Family Therapist gives me a perspective on the clinical realities of my clients’ work that is, to my knowledge, unique in the field. Mindfulness in Law Teacher Training, Certificated, 2015-2016.  Provided by Warrior One, this year-long program provided a foundation for teaching mindfulness specifically within the legal industry. 300-hour curriculum included several residential retreats at San Francisco Zen Center’s Green Gulch Farm with 25-person cohort comprised of experienced attorneys from throughout North America.
