Professional Experience:

My current practice focuses on legal, ethical, and business representation of psychotherapists, psychologists, and other licensed mental health professionals across the United States. I advise clinicians on professional corporation formation under the Moscone-Knox Act, multi-state telehealth and licensure compliance, HIPAA and CMIA privacy obligations, CANRA and Tarasoff duties, clinical documentation, subpoena and records release issues, board complaint exposure, and the corporate, employment, and contracting questions that arise in the operation of a clinical practice. I also represent licensed psychologists and psychotherapists in administrative proceedings before the Office of the Attorney General in response to formal accusations from their licensing boards. Through Lubofsky PC, I advise clinicians nationwide; through AttorneyTherapists.com and LawyerTherapists.com – both platforms that I founded – I have published more than 100 articles on legal and business issues for mental health professionals; and in 2026 I delivered the keynote presentation on EAP laws, ethics, and mental health at the U.S. Department of Energy’s Annual EAP Contractor Training.
